1. Introduction
These terms of service ("Terms") govern your use of the MOT Checkup website at motcheckup.co.uk ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
MOT Checkup reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Service Description
MOT Checkup provides an online tool for checking the MOT test history of vehicles registered in England, Scotland, and Wales. The Service allows users to enter a vehicle registration number and view the vehicle's MOT test history, including pass/fail results, mileage readings, advisory notices, and defect details. Additional features may include mileage anomaly detection, AI analysis, MOT expiry reminders, and premium reporting tools.
3. DVSA Data Attribution
MOT test data displayed on MOT Checkup is sourced from the Driver and Vehicle Standards Agency (DVSA) via their official MOT history API. MOT Checkup is not affiliated with, endorsed by, or connected to the DVSA, GOV.UK, or any UK government department. The DVSA data is Crown Copyright and is used under the terms of the Open Government Licence v3.0.
We present DVSA data as-is and supplement it with our own analysis, including mileage anomaly detection and AI-generated insights. Our analysis and commentary are provided by MOT Checkup and do not represent the views or findings of the DVSA.
4. Accuracy of Information
While we strive to display accurate and up-to-date information, MOT Checkup makes no warranty or guarantee regarding the accuracy, completeness, reliability, or timeliness of the data displayed on the Service. MOT data is provided by the DVSA and may contain errors, omissions, or delays in updates.
The information provided by MOT Checkup is for general informational purposes only. It should not be relied upon as the sole basis for any decision, including but not limited to vehicle purchase decisions, assessments of vehicle roadworthiness, or legal matters. We strongly recommend that users independently verify any information obtained through the Service.
Specifically, MOT Checkup does not guarantee that:
- MOT data is current or has been updated in real time
- Mileage readings are accurate (the MOT records what the odometer displays, which may have been tampered with)
- Our mileage anomaly detection will identify all instances of odometer fraud
- AI-generated insights or analysis are free from errors
- The Service will be available without interruption or error
5. Free and Premium Services
5.1 Free Service
The basic MOT history check is provided free of charge with no account registration required. Free users may be subject to rate limits on the number of lookups per day. We reserve the right to modify, limit, or discontinue the free service at any time without notice.
5.2 Premium Service
MOT Checkup may offer premium subscription plans that provide additional features, such as enhanced reports, bulk lookups, API access, or MOT reminders. The specific features, pricing, and billing terms for premium plans will be clearly displayed at the point of purchase.
6. Payment Terms
Premium subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). Payment is processed securely by Stripe. By subscribing, you authorise us to charge your payment method at the applicable rate for your chosen plan.
Prices are displayed in British Pounds (GBP) and include VAT where applicable. We reserve the right to change pricing with 30 days' notice. Price changes will not affect existing subscribers until their next renewal date.
7. Cancellation & Refund Policy
You may cancel your premium subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until your paid period expires.
We offer a full refund within 14 days of your initial purchase if you are not satisfied with the premium service. To request a refund, contact us at info@motcheckup.co.uk. Refunds are not available after the 14-day period or for subsequent renewal payments.
8. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any unlawful purpose or to facilitate illegal activity
- Attempt to gain unauthorised access to any part of the Service, its servers, or databases
- Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission
- Overwhelm the Service with an excessive number of requests (denial of service)
- Reproduce, redistribute, or resell data obtained from the Service without our written permission
- Use the Service to harass, stalk, or invade the privacy of others
- Misrepresent your identity or the source of data obtained from the Service
We reserve the right to suspend or terminate access to the Service for any user who violates these terms, without notice or refund.
9. Intellectual Property
The MOT Checkup website, including its design, code, text, graphics, logos, and analysis algorithms, is the property of MOT Checkup and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on any part of the Service without our prior written consent.
MOT test data is Crown Copyright (DVSA) and is used under the Open Government Licence. Our value-added analysis, commentary, and presentation of that data remain the intellectual property of MOT Checkup.
10. Limitation of Liability
To the fullest extent permitted by law, MOT Checkup and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to:
- Your use of, or inability to use, the Service
- Any inaccuracy, error, or omission in the data displayed
- Any decision made based on information obtained through the Service
- Unauthorised access to or alteration of your data
- Any interruption or cessation of the Service
In no event shall our total liability to you exceed the amount you have paid to us in the 12 months preceding the event giving rise to the claim, or 100 pounds, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
12. Indemnification
You agree to indemnify, defend, and hold harmless MOT Checkup, its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Third-Party Links
The Service may contain links to third-party websites or services that are not owned or controlled by MOT Checkup. We are not responsible for the content, privacy policies, or practices of any third-party websites. You access third-party websites at your own risk.
14. Termination
We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. If you have a premium subscription, termination for breach does not entitle you to a refund.
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have additional rights under the laws of the country in which you reside.
16. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MOT Checkup regarding your use of the Service. They supersede any prior agreements, communications, or understandings, whether written or oral.
